Please read these Terms of Service ("Terms") carefully before using MemoryHelper software and the website at toolapps.online ("Service"). By purchasing or using MemoryHelper, you agree to be bound by these Terms.

1. Product Description

MemoryHelper is a macOS menu bar application that monitors and optimizes system memory usage. The software runs locally on your Mac and provides real-time memory monitoring, one-click memory cleanup, and automated memory management features.

2. License

Upon purchase, you receive a perpetual, non-exclusive, non-transferable license to use MemoryHelper.
One license key activates up to 3 Macs owned by the same individual.
The license is for personal use. Redistribution, resale, or sublicensing of the software or license key is prohibited.
The license includes all future updates to the current major version at no additional cost.

3. Free Trial

MemoryHelper offers a free 3-day trial with full functionality. No payment information is required for the trial. After the trial period, a license key is required to continue using the software.

4. Pricing and Payment

MemoryHelper is a one-time purchase at the price listed on our website (currently $4.99 USD).
Payments are processed by Creem (creem.io), our Merchant of Record. Creem handles all payment processing, applicable tax collection, and currency conversion.
By completing a purchase, you also agree to Creem's Terms of Service.
Prices may change at any time, but changes will not affect existing purchases.

5. Delivery

After successful payment, your license key (activation code) will be delivered to the email address you provided during checkout. Delivery is typically instant but may take up to 30 minutes. If you do not receive your license key, please contact support@toolapps.online.

6. Refund Policy

Since MemoryHelper offers a free 3-day trial with full features, we encourage you to evaluate the software before purchasing.
If you experience technical issues that prevent the software from functioning and we are unable to resolve them, you may request a refund within 14 days of purchase by contacting support@toolapps.online.
Refunds are processed through Creem and returned to the original payment method.

7. Intellectual Property

MemoryHelper and all associated content, including but not limited to the software, website, logos, and documentation, are the intellectual property of the developer. All rights not expressly granted in these Terms are reserved.

8. Restrictions

You agree not to:

Reverse engineer, decompile, or disassemble the software.
Modify, adapt, or create derivative works based on the software.
Share, distribute, or publicly disclose your license key.
Use the software for any unlawful purpose.
Attempt to bypass or circumvent the license activation system.

9. Disclaimer of Warranties

MemoryHelper is provided "as is" without warranty of any kind, express or implied. We do not warrant that the software will be error-free, uninterrupted, or meet your specific requirements. Memory optimization results vary depending on your system configuration and workload.

10. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the software, even if we have been advised of the possibility of such damages. Our total liability shall not exceed the amount you paid for the software.

11. Termination

We may terminate your license if you violate these Terms. Upon termination, you must cease all use of the software and delete all copies. Sections regarding intellectual property, disclaimers, and limitation of liability survive termination.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a new revision date. Continued use of the software after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms shall be resolved through good-faith negotiation first, and if necessary, through arbitration or the courts of competent jurisdiction.
